Before any orders are accepted from new customers, cfacts requires an executed copy of our simple, single-page Terms and Conditions. You may download and print the form using the link above. 1. Terms: Your desire to utilize cfacts’ services (including Online services) is based on your satisfaction. No exclusivity contract will ever be required. We believe a satisfied customer will continue to use cfacts for their underwriting needs.
2. Fees:
(a) For fees not paid at closings, cfacts will charge
and customer agrees to pay for orders placed by customer and completed
by cfacts.
(b) cfacts will provide a monthly invoice to customer
for reports that are not paid at closing. All invoices are payable
within fifteen (15) days from the date of the invoice. In the event
any charges are not paid within thirty (30) days, customer will be
deemed in default if they fail to pay any amount due according to
the terms of the invoice. If the customer is in default, cfacts
may: (i) cancel reports in process; (ii) suspend account until
default is satisfied; (iii) require prepayment for future orders;
(iv) proceed with litigation to recover the money due, customer
assuming all costs and fees incurred due to such action.
(c) When customers need to cancel an order, the request
must be made in writing and faxed to the appropriate department,
immediately.
(d) cfacts may, upon sixty (60) days prior written
notice to customers, increase prices for certain services provided.
(e) Customer agrees to furnish cfacts, within ten (10)
days of a change, accurate invoice routing information in order to
limit late payments due to inter-organizational routing procedures.
3. Responsibility of cfacts: cfacts uses its best effort to ensure that the information presented in all reports provided to customers is accurate. However, cfacts shall not be responsible, and expressly disclaims any and all liability, for accuracy of the information contained in the Public Records, which are accessed by cfacts. cfacts assumes responsibility only for reporting the information as it appears in the Public Records.
4. Responsibility of Customer: Customers experiencing discrepancies, errors, and/or problems on a report are required to contact cfacts immediately so that we may initiate an investigation and attempt to resolve said situation with minimum exposure to cfacts and customer. cfacts does not assume liability for any claim based upon or arising out of discrepancies, errors, and/or problems where failure to follow this procedure has resulted in increased exposure to cfacts.
5. Customer Cooperation: cfacts’ success in providing Real Estate Information reports depends in large measure on our customer's cooperation as "partners". Accordingly, the customer will provide as much detail as possible to assist cfacts in completing reports (e.g. legal description, number of mortgages, property location, correct names and spellings, proper county, etc.). Much of this information can be obtained from loan applications and/or credit reports. All orders received after 2:00pm est will be considered received on the following business day for production purposes. cfacts will attempt to place the order upon receipt. However, time restraints can delay the placement of the order with our various sources across the country. Orders received on holidays or weekends will be considered received on the next regular workday. Daily production begins at 8:00AM EST, Monday through Friday.
